Personal Injury occurs when a person negligently injures another. Personal injury law is a broad area of law that allows an injured person to recover damages caused by another’s negligence. A personal injury lawsuit may seek to recover damages for medical expenses, lost wages, property damage, pain and suffering, emotional distress, loss of companionship, lost future earnings, court costs, and attorney fees.

When you or a loved one is negligently injured, deciding on a course of action can be just as stressful as the injury itself. The decisions you make can have important and oftentimes unforeseen consequences. Each personal injury claim is unique and has different guidelines and restrictions that must be followed. We understand what you are going through and we know the law. Let us handle the legal issues so you can focus on your recovery and your family.

*Numerous independent surveys have confirmed that GKT is the Most Preferred Injury law firm in the Ohio Valley.

Personal Injury Frequently Asked Questions

My insurance company told me that hiring an attorney is not necessary. Should I handle the case myself?

Insurance companies will assure you that they will treat you fairly and it is unnecessary to hire an attorney. However, this is rarely the case.

In personal injury cases, you should understand that insurance companies have a team of lawyers working for them. They DO NOT represent you. Their job is to minimize the insurance companies’ losses by aggressively defending claims, offering “quick settlements” and low balling offers.

What is my case worth?

Before determining the value of any case, it is necessary to review all available information, including medical records, police reports, lost wages, and the injured party’s medical progress. Your case may also warrant compensation for future impairment, future lost wages, ongoing treatment, and pain and suffering. Every case is different, and we will provide you with the individualized attention that you and your case deserve. An attorney who states that your case is worth a certain dollar amount without adequately investigating your claim is performing you a disservice.

What can I do if I can’t afford an attorney?

Most attorneys work on a contingency fee basis. This means that you will not be charged a fee unless a settlement or judgment is recovered on your behalf. At GKT, we handle most cases on a contingency fee basis. We also advance the costs associated with investigating your case, including the cost of obtaining all necessary records. You are responsible for these costs only if money is collected for you. Our firm charges a competitive fee for personal injury cases that are at or below the standard in the industry.

When is the right time to accept a settlement offer?

Accepting a settlement offer can be a difficult decision. You should realize that once the matter is settled, the case is closed. One of our primary concerns is to help our clients obtain the medical treatment necessary to make a full recovery. A settlement offer should only be entertained when the full extent of your injuries are known and a determination can be made of the impact those injuries may have on you. Accepting an offer beforehand can place a financial burden on you and your family for years to come. We will always keep you informed on the progress of your case and any settlement offer that is presented. The final decision whether to accept an offer or not is always up to our client.

Once a lawsuit is filed, how long does it take until the case is finished?

Every case is different which makes it difficult to predict how long a lawsuit will last. A primary factor in any lawsuit includes the availability of information and the willingness of those individuals involved in the case to provide us with the information needed to pursue your claim. Cases can vary in length from weeks, months, even years in some instances. The more cooperation our office receives, generally the quicker it is to resolve the matter. We can assure you that your case will never be delayed by this office, and we will keep you informed at all stages of your case.
